Puducherry Assembly floor test to be held on 22 Feb

The Leader of the Opposition N. Rangasamy along with 13 other Hon’ble Members of the Legislative Assembly called on Raj Nivas on 17th February 2021 and submitted a letter dated 17.2.2021 signed by all 14 of them, stating that the present Government has lost its majority consequent to the resignation of four of the legislators from their membership of the Legislative Assembly in addition to the disqualification of one member. They averred that the present government has been reduced to a minority and lost its legitimacy to continue. The delegation made a request that the present Government needs to prove the majority in the floor of the Assembly.

Today (18.02.2021), again the Leader of Opposition Shri N. Rangasamy, MLA (NR Congress), Shri A. Anbalagan, MLA (AIDMK) and Shri v. Saminathan, MLA -Nominated (BJP) met Hon’ble Lt. Governor and reiterated their request for the present Government to prove the majority in the floor of the House Hon’ble Lt. Governor has noted that consequent to the disqualification of one Member and resignation of four Members of the Legislative Assembly, the strength of the Assembly stands altered as below:-

Therefore, in exercise of the powers conferred under Art 239 of the Constitution of India read with the provisions of the Government of Union Territories Act, 1963, in particular Section 6 of the Government of Union Territories Act, 1963 and in consonance with the orders of the Hon’ble Supreme Court of India in Writ Petition (C) No.439 of 2020 in Shivraj Singh Chouhan & Ors. Vs. Speaker Madhya Pradesh Legislative Assembly & Ors., Hon’ble Lt. Governor has passed the following directions and conveyed to Hon’ble Chief Minister:-

i) The Session of the Legislative Assembly, Puducherry shall be summoned on Monday the 22nd Feb 2021.

ii) The meeting to be convened in pursuance of (i) above shall be confined to a single agenda, namely whether the government of the incumbent Chief Minister continues to enjoy the confidence of the House.

iii) Voting on agenda (ii) above shall take place by show of hands.

iv) The entire proceedings before the Legislative Assembly shall be videographed.

v) The floor test in pursuance of the above directions shall be concluded by 5.00 P.M. on 22.02.2021 and the proceedings shall not be adjourned/delayed or suspended at any cost.

vi) All authorities, including the Legislative Assembly Secretary, shall ensure that there is no breach of law and order in the course of the proceedings and that the floor test is conducted in a peaceful manner.

Hon’ble Lt. Governor has directed Chief Secretary and DGP that necessary arrangements will be made to ensure that there shall be no restraint or hindrance whatsoever on any of the MLAS in attending the session of the Legislative Assembly. Arrangements for their security, shall also be provided.

Proper law and order arrangements are to be made in the UT of Puducherry during the conduct of trust vote in the Legislative Assembly on 22nd Feb 2021.
