 The pain of being Hindu in Secular India; a sad story of discrimination of Hindus in India and a possible Bhumiputra solution.

Today most educated Hindus know that Secular Constitution of India has articles from 25 to 30 that are totally discriminatory against us Hindus and the word “SECULAR” is an oxymoron as it is in practice very “Churchly” in nature favouring the practices of church almost in sync with Cannon law of medieval times. Whenever the term “Constitutional Morality” is used; it has been used against Hindus, Hindu practices and traditions as our Constitution is nothing but a modified remnant of the one which the imperial British used, to rule over India. It is overbearing on Hindus with a predominantly pro medieval european (protestant) bias in its interpretation and application. This has destroyed the very philosophy of “Vasudaiva Kutumbakam”, the live and let live philosophy of Sanatana Dharma which Hindus follow.

Indian Secular Constitution in application and actual practice today is of the minority by the minority and for the minority. In simple terms the Nehruvian adaptation of constitution which is followed today in India is nothing but blatant state enforced atrocity and discrimination of native Hindus.

The discrimination against Hindus is so bad that hard core Hindu organisations like Ramakrishna Mission, Arya Samaj, Manipal group etc.., have claimed to be “MINORITY” to escape government led discriminatory control over their institutions. The most recent one that come to our notice is the Lingayat agitation led by a fringe group among them, claiming to be “Not Hindus” and demanding to be recognised as a separate religion. It is also for us educated Hindus to understand, appreciate and debunk how Congress uses these fault-lines to divide Hindu society for votes in elections.

Fringe players like Shashi Tharoor, Bharka Dutt, Siddarth Vardarajan, Rajdeep Sardesai, Ram Guha(and a host of journalists, intellectuals with very pro Congress and Communist bias) who in my opinion, are not practicing Hindus and whose only qualification is closeness to earlier “Anti Hindu” regimes make a mockery of the genuine claims of the natives of this great nation. They never let go of a chance to deride the great all-inclusive Sanatana Dharma which is today colloquially referred as Hinduism. It is a travesty that such divisive and anti-Hindu anti-native fringe players are heard over saner Hindu voices which are asking for equality and respect for Hindus from the constitution, its enforcement by our elected government and interpretation by post-colonial judiciary.

Indian Judiciary in my opinion: is the most spectacular failure of post independent India; especially when it comes to enforcing equality and justice the very two feet on which it is supposed to stand. Indian Judiciary has been particularly severe against the real natives of this land the Hindus. The arbitrary use of the term “Constitutional Morality” and its Interpretation by our Judiciary are being done repeatedly, to trespass into areas where the founding fathers never envisaged judiciary to go. Using a figment of Constitutional Morality which is very protestant/communist by nature; they have denied the majority Hindus of this nation the right to practice their religion in peace. Sabarimala today is nothing but a court created disaster for the very accommodative Hindus. In my very personal opinion: Sabarimala verdict is nothing but legalised trespass and trampling of Hindu culture, traditions and faith.

The way Indian Judiciary has conducted itself regarding “Ram Janma Bhoomi” is evidence of the fact that “Indian Judiciary today is nothing but a fossilised vestigial remnant of colonial British raj”. It has the same Macaulayism inspired ethos, outlook, attitude and approach towards natives and native faith as that of pre-independent judiciary of India.

Our Judiciary has not held itself in other areas too. It has failed miserably with highest pendency of cases in courts. Common man has to wait for decades before he sees justice or dies without it. In a conversation which I had with a millionaire friend of mine from US, the main reason he and his friends were unwilling to invest in India was due to the very nature of Justice apparatus and the functioning of Indian Judiciary. He talked about the frivolous petitions, delay and high legal fees which an investor friend of his had to face when he did invest in India. Indian Judiciary today is exactly what it should not be.

We have reached this stage because of decades of Nehruvian adaptation and enforcement of pseudo secular and very discriminatory constitution by our elected governments and its interpretation by post-colonial yet very colonial Macaulayism inspired Indian Judiciary. It is time we Hindus unite and overcome the discriminatory features present in our constitution. Change the nature of our constitution from: of the minority, by the minority and for the minority bias to of the people, by the people and for the people of real democracy. Practicing Hindus should not stop at the demands of Hindu charter but should ask for a law similar to Bhumiputra law of Malaysian Constitution. Which protects the rights of native Malay moslems over non moslems, Chinese and Indian immigrants. Hindus should demand for first rights over the resources of this great nation. Practitioners of non-Indic faiths should be treated as equal with respect to votes and democracy is concerned; but must prove their allegiance to the nation. I make this very sensitive point as I have come across a few people in public life who are more loyal to Vatican than they are to India although they call themselves Indian.

I also advocate that to bring a like the bhumiputra law of Malaysia, we Hindus too should vote in unity only to those who are willing to bring in an Indian version of Bhumiputra law favouring Hindus and other Indic based faith. Practitioners of native Indic faiths (Hindus, Buddhists, Jains, Sikhs and indigenous North East faiths) only should have rights to own and set up businesses of scale beyond a point in India.

I know that this proposal by me will be considered blasphemous to our constitution and opposed vehemently by the minority, media, faux intellectuals etc.., but that is the very thing required right now to highlight the discrimination we native Hindus face in India by our constitution.

For; if we ask for equality we will be snubbed but if we ask for priority status by law then; at least we may achieve equality!!!

PS: In my opinion Congress today is an epitome of “Anti-Hindu and Anti-Nativism” and will do everything to maintain status-quo pro minority bias of constitution it adapted post-independence. Hindus stand a chance only with BJP which although not a very pro Hindu party is at least not anti-Hindu. So my suggestion for Hindus is vote unitedly for BJP and demand those elected to bring Bhumiputra law favouring Hindus.
