Ban on face masks unconstitutional: Hong Kong court

Hong Kong’s High Court today ruled that the recently introduced regulation prohibiting residents from wearing face masks was unconstitutional.

The government introduced Prohibition on Face Covering Regulation under the Emergency Regulations Ordinance (ERO) amid an escalation in civil unrest and violence in the city, which banned residents from wearing face masks. It argued that the ordinance was necessary to help the police identify perpetrators of violence during protests.

The High Court ruled that the ERO was incompatible with the city’s mini-constitution, known as the Basic Law.

The court said it would convene a subsequent hearing on the question of relief with regard to the regulation.
