Ranjan Gogoi, Chief Justice of India reproached advocate Manohar Lal Sharma today for filing PIL (Public Interest Litigation) petitions.
PIL is a petition that can be filed by any individual or a citizen group in the court seeking justice in any Public Interest issues.
Manohar Lal Sharma is an Indian lawyer. He is known for filing a series of Public Interest Litigation petitions before several courts in India.
Sharma was the first person to file a petition before the Supreme Court In the Indian coal allocation scam. He also defended the accused in the 2012 Delhi gang rape case.
Sharma has also challenged the validity of laws appointing the National Judicial Appointments Commission. However taking cognisance of certain “irresponsible and scandalous allegations leveled by him” against India parliamentarians, Court issued show cause notice to him asking “why he should not be debarred from filing and/or canvassing any Public Interest Litigation”.
ML Sharma filed a PIL against Arun Jaitley, Minister of Finance and the petition seeks court order to restrain the Finance Minister from using capital reserves of the Reserve Bank of India (RBI).
Gogoi J. said that it is time to ban Sharma from filing PILs. “Mr. Sharma, the day has come to ban you from filing PILs.”
2014, CJI (Chief Justice of India) RM Lodha slaps Rs. 25,000 cost on ML Sharma and dismissed PIL for quashing sale of AIR India Hotels.
“Filing PIL is not a game” says Advocate M.S.Bhuvaneswary from Madras High Court.
She also said to Indsamachar Reporter that “PIL should be filed for the benefit of Public and not for an individual’s fame. Sharma may be filing PIL just like that reading Magazines and watching News. Advocate is a profession which has some responsibility towards Public Welfare and we being an Advocate should keep that in mind. I think Mr.Sharma will henceforth make a note before filing any PIL”.
